The Board was approached by Mr. James Haggerty, representing property owner Mrs. Susan Haggerty, with a Site Plan Application proposing to convert the office space currently being utilized at a car repair shop located at 6416 Cooper Street (313.000-1-12) into a ballistics office. Mr. Haggerty explained that he owns an online sporting goods company that also deals in firearms. Mr. Haggerty has a Federal Fire Arms License and would like to move his current office from his living room to the office space at the car repair shop. The office space will be used to store the fire arms that are being transferred. Per ATF regulations, all firearms must be locked up at all time. Mr. Haggerty currently has approval from ATF to store the firearms in his home, but he is able to transfer his approvals to a new office space. There will be no ammunition stored at this site. The car repair business that is currently being operated on this property obtained a Use Variance several years ago and is grandfathered to operate a business in a R3 District. Roger explained that the challenge is the zoning impact as a new business would be coming in. Roger inquired if Mr. Haggerty has any documentation from the ATF denoting their acceptance to his proposed arrangement. Mr. Haggerty explained that he is unable to get ATF approval until he received approval from the Board. Roger stated that to avoid spot zoning a Special Permit could be granted to add another entity to the current business.
35 Chuck Smith made a motion to approve the Site Plan Application as submitted for Mrs. Susan Haggerty to convert the current office space currently being utilized at a car repair shop into a ballistics office on her property located at 6416 Cooper Street; motion was seconded by Paul Kulpa; Joseph Malecki voted Yes; Roger Potenski voted Yes; John Smith voted Yes; Fran Szarek voted Yes; Scott Toukatly voted Yes; motion carried.
36 Roger Potenski made a motion to approve a Special Permit for Mrs. Susan Haggerty to operate a ballistics office as described in the Site Plan Application on her property located at 6416 Cooper Street since activity is already occurring at this address; motion was seconded by John Smith; Paul Kulpa voted Yes; Joseph Malecki voted Yes; Chuck Smith voted Yes; Fran Szarek voted Yes; Scott Toukatly voted Yes; motion carried.
